How to Revoke a Power of Attorney: Step-by-Step Guide

If your relationship with your agent has changed or your agent is no longer competent to handle your affairs, you can revoke the existing POA.

 

Here is how to do it properly:

 

1.     Prepare and Destroy All Old POA Documents: Start by drafting a formal revocation letter. This letter serves as the official cancellation of your previous POA. Once the letter is prepared, make sure to destroy all copies of the old POA to prevent any confusion or misuse.

 

2.     Create a New POA Document:  After revoking the old POA, it’s time to create a new one. Fill out a new POA form, designating a different agent (if applicable) to handle your affairs moving forward. Be sure that this new POA clearly supersedes the previous one.

 

3.     Signing the New POA and Revocation Letter: With the revocation letter and new POA document ready, it’s time to sign both documents. Just like the original POA process, you’ll need to follow your state’s specific signing and notarization requirements. Once signed, the old POA is no longer valid, and the new one takes its place.
